Filing a Notice of Appeal after a Criminal Conviction

Filing a notice of appeal is the first step that you must take if you wish to overturn an unfair or wrongful conviction in New York State; however, it is important to understand that your case will be subject to strict time limitations. Failing to file a notice of appeal on time can result in the dismissal of your case, so timely action will be crucial. Although this step isn't a difficult process in and of itself, it is highly recommended that you have an experienced lawyer file the notice on your behalf. Once the notice of appeal has been filed, you will have nine months to prepare your case.

In order to properly file a notice of appeal, your attorney will need to keep several important aspects in mind:

  • The notice of appeal must be properly drafted
  • Two copies must be filed with the clerk of the criminal court
